These Terms of Service ("Terms") are a binding agreement between you and [Legal business name], doing business as Evenly ("Evenly," "we," "us," "our"). They govern your use of evenlybody.com (the "Site") and every purchase you make from us.

By visiting the Site, creating an account or placing an order, you agree to these Terms, our Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, don't use the Site.

Please read section 15 carefully. It requires you to resolve disputes through individual arbitration and waives class actions and jury trials.

1. Eligibility

  • You must be at least 18 years old, or the age of majority where you live, to use the Site or place an order.
  • By ordering, you confirm that all the information you give us is accurate and that you're authorized to use the payment method you provide.

2. Health and safety disclaimer

Our products are personal-care massage devices for cosmetic use. They are not medical devices. They are not intended to diagnose, treat, cure or prevent any disease or medical condition.

  • Results. Any results refer to the appearance of skin and cellulite. Results vary from person to person and depend on consistent use as directed. We don't promise any specific result.
  • Not medical advice. Content on the Site, in our emails, on social media and in our guides is for general information only. It is not medical advice.
  • Who should not use the device: don't use it, or first ask your doctor, if you:
    • are pregnant or nursing
    • have varicose veins, blood clots or a circulatory disorder
    • take blood-thinning medication
    • have a pacemaker or other implanted electronic device
    • have broken, irritated, sunburned or infected skin, or skin cancer
    • have a medical condition affecting the area you plan to treat
  • Follow the instructions. Always follow the included instructions:
    • Start on the lowest level.
    • Keep the device moving with oil.
    • Stop if you feel pain or notice unusual bruising, swelling or irritation.
  • Your responsibility. You use the products at your own risk, and you're responsible for deciding whether they're right for you.

3. Products, pricing and availability

  • Descriptions and photos. We try to describe and photograph our products accurately. Colors, packaging and minor design details may vary slightly.
  • Prices. Prices are in US dollars and may change at any time without notice. The price that applies is the one shown at checkout when you order.
  • "Compare-at" or "if bought separately" prices show the total of the items bought individually on our Site.
  • Our right to change things. We may discontinue products, limit quantities or change bundles, gifts and offers at any time.
  • Free gifts:
    • They have no cash value and can't be exchanged.
    • They may be substituted with an item of equal or greater value if the original is unavailable.

4. Orders

  • Acceptance. Your order is an offer to buy. We accept it only when we ship it. The order confirmation email confirms that we received your order, not that we accepted it.

  • When we may refuse or cancel an order. We may refuse, limit or cancel any order, including after you receive a confirmation. Reasons include:

    • suspected fraud or unauthorized payment
    • suspected resale
    • an error in price, description or availability
    • orders that exceed quantity limits
    • accounts that have abused our guarantee or policies

    If we cancel an order you have already paid for, we'll refund you in full.

  • Pricing errors. If a product is listed at an incorrect price because of a typo or system error, we may cancel orders placed at that price, even after confirmation.

  • No resale. Products are sold for personal use only. Buying to resell is not allowed.

5. Payment

  • Payment is taken when you place your order.
  • You authorize us and our payment processors to charge the full amount shown at checkout, including shipping and any taxes.
  • Sales tax is added where required by law.

6. Shipping, returns and refunds

  • Shipping is governed by our Shipping Policy.
  • Returns, refunds and the 180-day money-back guarantee are governed by our Refund Policy.
  • Both are part of these Terms. Title to products and the risk of loss pass to you when the carrier delivers your order.

7. Subscriptions

We may offer subscription products in the future, such as massage oil refills. If we do, the price, billing frequency and cancellation steps will be clearly shown before you sign up. You'll be able to cancel online at any time before your next billing date.

8. Accounts

  • You're responsible for keeping your login details confidential and for all activity on your account.
  • Tell us immediately at info@evenlybody.com if you suspect unauthorized use.
  • We may suspend or close accounts that violate these Terms.

9. Reviews and content you submit

  • License. When you submit a review, photo, video, comment or other content, you grant us a worldwide, royalty-free, perpetual license to use it. That means we may use, reproduce, edit for length, display and share it in connection with our business, including in advertising. You can ask us to stop using your content at info@evenlybody.com.
  • What you confirm. By submitting content, you confirm that:
    • it reflects your honest, personal experience
    • you own it or have the right to share it
    • it doesn't infringe anyone's rights
    • it isn't false, misleading, obscene, hateful or unlawful
  • Our rights. We may refuse, remove or edit content for any lawful reason. We never edit a review to change its meaning or rating.
  • Disclosure. Reviews from customers who received a free product are labeled as such.

10. Marketing emails and text messages

  • Email. If you opt in, we'll send you marketing emails. You can unsubscribe at any time using the link in any email.
  • Text messages. If you opt in, you agree to receive recurring automated marketing texts at the number you provide.
    • Consent is not a condition of purchase.
    • Message frequency varies. Message and data rates may apply.
    • Reply STOP to cancel, or HELP for help.

11. Prohibited uses

You may not:

  • use the Site for any unlawful purpose
  • place fraudulent orders or file false claims, chargebacks or reviews
  • scrape, copy or harvest content or data from the Site
  • interfere with the Site's security or operation, or upload viruses or harmful code
  • impersonate anyone, or misrepresent your connection to anyone
  • copy our product pages, images, videos or copy for your own store or ads

We may end your access to the Site at any time if you break these rules.

12. Intellectual property

  • What we own. Everything on the Site belongs to Evenly or its licensors and is protected by copyright, trademark and other laws. This includes text, photos, videos, graphics, logos, the Evenly name and the "Lift & Release" name and method. Evenly™ and Lift & Release™ are our trademarks.
  • What you may do. You may view the Site for personal, non-commercial use.
  • What you may not do without our written permission: copy, reproduce, modify, distribute or create works based on any part of it.

13. Disclaimer of warranties

  • No implied warranties. Except for the express guarantee in our Refund Policy, the Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied. This includes the warranties of merchantability, fitness for a particular purpose and non-infringement.
  • The Site. We don't guarantee that the Site will be uninterrupted, error-free or free of viruses.

14. Limitation of liability

  • Indirect losses. To the fullest extent permitted by law, Evenly and its owners, employees, suppliers and partners are not liable for any indirect, incidental, special, consequential or punitive damages. This includes lost profits, data or goodwill arising from your use of the Site or our products.
  • Maximum amount. Our total liability for any claim is limited to the amount you paid for the product that gave rise to the claim.
  • What this section doesn't limit. Liability that can't be limited by law, such as liability for gross negligence or willful misconduct.

15. Disputes: arbitration and class action waiver

  • Contact us first. Before filing any claim, email info@evenlybody.com and give us 30 days to try to resolve it informally.
  • Arbitration. If we can't resolve it, any dispute arising from these Terms, the Site or our products will be settled by binding individual arbitration. Arbitration is run by the American Arbitration Association under its Consumer Arbitration Rules. It will take place in your county of residence or by video.
  • Small claims court. Either of us may still bring an individual claim in small claims court if it qualifies.
  • Class action waiver. You and Evenly each waive the right to a jury trial and the right to take part in a class action, class arbitration or representative action.
  • Opting out. You may opt out of this arbitration agreement within 30 days of your first purchase by emailing info@evenlybody.com with the subject line "Arbitration opt-out."

16. Indemnification

You agree to defend, indemnify and hold Evenly harmless from any claims, losses and expenses, including reasonable legal fees, arising from:

  • your breach of these Terms
  • your misuse of the products, including using them against the instructions or warnings
  • your violation of any law or third-party right

17. Third-party links and services

The Site may link to third-party websites or use third-party services, such as payment processors and review apps. We aren't responsible for their content, policies or practices.

18. Governing law

  • Which law applies. These Terms are governed by the laws of the State of [State]. The federal laws of the United States apply as well. Conflict-of-law rules don't apply.
  • Where cases go. Any matter not subject to arbitration will be heard in the state or federal courts located in [County, State].

19. Changes to these Terms

We may update these Terms at any time by posting the new version on this page. Changes apply to orders placed after the update. Continuing to use the Site after a change means you accept it.

20. General

  • If a part is unenforceable. If any part of these Terms can't be enforced, the rest stays in effect.
  • Not enforcing a right. If we don't enforce a right, that doesn't mean we've waived it.
  • Entire agreement. These Terms, together with our policies, are the entire agreement between you and Evenly about the Site and your purchases.
  • Your legal rights. Nothing in these Terms limits any rights you have under consumer protection laws that can't be waived.
